It is often said that “people are policy” and the prospect of Harold Koh as a legal adviser to the US State Department unfortunately illustrates that vividly.

Koh is a transnationalist who believes in incorporating foreign legal traditions into US legal decisions, including Shariah law:

A New York lawyer, Steven Stein, says that, in addressing the Yale Club of Greenwich in 2007, Koh claimed that “in an appropriate case, he didn’t see any reason why sharia law would not be applied to govern a case in the United States.”

Frequently, I am asked if Shariah law really does pose a threat to America. Skeptics doubt that Shariah can infiltrate our society, despite all the evidence to the contrary.

But the most worrisome evidence comes from that old cliche’: People are policy.
